Ukraine is fourth by the number of considered cases against it by the European Court

Ukraine is fourth after Russia, Turkey and Romania by the number of considered cases against it by the European Court. This was informed to the UNN by the press service of the Ministry of Justice. 

As was informed, cases against Ukraine considered by the European Court of Human Rights make up 7.5% of the total number of cases. 

Thus, the main reasons, which often cause complaints to the European Court of Human Rights against Ukraine, include non-fulfilment or long fulfillment of resolutions of national courts. 

Besides, people often address to the European Court because of long prejudicial inquiry in criminal cases and because of the long consideration of cases by courts. 

Violations of human rights in Ukraine, stated by the European Court, are caused by bad treatment of a person, being under the state’s control; shortcomings of legislation and administrative practice, causing imprisonment of a person without proper grounds; and shortcomings of judicial practice, causing violation of human right to fair trial. 

Another one reason is inefficiency of investigation of criminal cases, carried out by law-enforcement authorities, of the facts of death, disappearing of persons, and of the facts of cruel treatment by the representatives of state authorities, first of all in pre-trial centres for arrested persons and in places of imprisonment. 

Appeals to the European Court are cause as well by the improper material and living conditions of detention of persons, staying in pre-trial centres or in places of imprisonment, and failure to provide the stated category of persons with the decent medical assistance.
